§1. Definitions
The terms used in these Terms mean:
- Foundation — Fundacja Centaurus – Animality, with its registered office in Wrocław, ul. Skarbowców 23A/BUD.B3, 53-025 Wrocław, entered in the register of associations, other social and professional organisations, foundations and independent public healthcare institutions kept by the District Court in Wrocław, 6th Commercial Division of the National Court Register under KRS 0000257551, REGON 020319750, NIP 8982093147;
- password — the password to the buyer’s account received during registration;
- commercial information — any information intended directly or indirectly to promote goods or the seller’s image;
- buyer — a natural person who is at least 13 years old (if under 18, the consent of a statutory representative is required), as well as a legal person or an organisational unit without legal personality to which the law grants legal capacity, who places or intends to place an order (including a consumer);
- Civil Code — the Act of 23 April 1964 (Journal of Laws of 2019, item 1145, as amended);
- consumer — a natural person performing a legal act not directly related to their business or professional activity;
- account — a subpage of the shop where the buyer may access and modify data they have entered;
- login — an e-mail required to access the account, set by the buyer during registration;
- Terms — these terms of sale using means of electronic communication;
- registration — a one-off act of creating an account on the shop website;
- force majeure — an external event independent of the parties, unexpected and impossible to avoid or prevent;
- online shop (shop, portal) — the website available at goodvia.org through which the buyer may purchase goods;
- seller — Klub Fundacji Centaurus, with its registered office in Wrocław, ul. Skarbowców 23A/BUD.B3, 53-025 Wrocław, entered in the register of associations, other social and professional organisations, foundations and independent public healthcare institutions (also entered in the register of entrepreneurs) kept by the District Court in Wrocław, 6th Commercial Division of the National Court Register under KRS 0000278299, REGON 140974200, NIP 8943068607;
- party / parties — the seller (Klub Fundacji Centaurus) and the buyer;
- means of electronic communication — technical solutions enabling individual remote communication, in particular electronic mail;
- goods — movable items offered by the seller through the shop, including print-on-demand products and digital files;
- sale contract — a contract for the sale of goods within the meaning of the Civil Code, concluded using means of electronic communication;
- Consumer Rights Act — the Act of 30 May 2014 on consumer rights;
- order — a declaration of the buyer’s will aimed directly at concluding a distance sale contract.
§2. General provisions
- These Terms set out the rules of the seller’s sale of goods through the shop using means of electronic communication.
- The entire income from the sale of goods by the seller is allocated to statutory purposes related to ecology and animal protection.
- The seller shall deliver goods to the buyer free from defects.
- The seller and the buyer shall observe these Terms.
- Print-on-demand goods are produced after payment. Production time depends on the chosen print partner (Printful or Snapwear).
- Digital PDF files are sold under a personal, non-transferable licence. Resale of PDFs is prohibited.
§3. Commercial information
Commercial information about goods — in particular descriptions and prices — constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
No later than when the consumer expresses the will to be bound by a distance contract, the seller informs the buyer clearly, to the e-mail address provided, of the main features of the goods, the seller’s identity and address, the total price including taxes and delivery, payment and performance, the right of withdrawal, the model form, return costs, conformity, guarantees, the code of good practice, and out-of-court redress.
§4. Conclusion of the sale contract
- To conclude a sale contract the buyer selects goods, places an order stating data, e-mail, delivery place and payment method, accepts the summary and pays.
- The sale contract is concluded when the buyer has effectively completed and accepted the order and paid for the ordered goods.
- Purchase is possible after accepting these Terms and consenting to the processing of personal data necessary to perform the contract.
- When placing the order the consumer expressly confirms that they know the order entails an obligation to pay.
- Goods are passed for fulfilment after the payment is credited to the seller’s account.
- Delivery costs are shown clearly when the order is placed.
§5. Right of withdrawal (consumers)
A consumer who has concluded a distance contract may withdraw from it within 14 days without giving any reason.
To meet the deadline it is sufficient to send the statement before it expires. Details: Right of withdrawal. Model form: Withdrawal form.
The right of withdrawal does not apply to goods made to the consumer’s specifications, goods unsealed after delivery where return is barred for hygiene or health reasons, or digital content not supplied on a tangible medium after performance has begun with the consumer’s express prior consent.
The trader reimburses all payments, including standard delivery costs, no later than 14 days from receiving the withdrawal statement, and may withhold reimbursement until the goods are received back or proof of sending them back is supplied.
§6. Complaints
The buyer may file a complaint electronically via the contact form or in writing within 14 days from the day the reason became apparent. The seller examines it within 14 days. Silence means the complaint is accepted. See also Complaints. Contact: shop@goodvia.org.
§7. Conformity of the goods with the contract
The trader is liable for lack of conformity existing at the time of delivery and revealed within two years of that time. The consumer may demand repair or replacement, and in the cases provided by law a price reduction or withdrawal.
§8. Personal data
Personal data are processed to perform the contract and on the terms set out in the Privacy policy.
§9. Newsletter
The buyer may consent to the newsletter and may withdraw consent at any time.
§10. Final provisions
- None of these Terms limits the consumer’s rights under the law in force in the Republic of Poland.
- In matters not regulated, the law of Poland applies.
- The seller may amend these Terms; amendments apply from publication on the portal.
